Guideline 11 – Supreme and County Court breach proceedings

Victoria Legal Aid (VLA) will generally make a grant of legal assistance to a person for proceedings in the Supreme Court or County Court for breach of the following orders:

  • a community-correction order

or

  • a community-based order

or

  • intensive corrections order

or

  • suspended sentences

or

  • an order under the Serious Offenders Act 2018.

Documentary requirements

Applications under this guideline are normally only within the simplified grants assessment process.

Lawyers seeking a grant of legal assistance via the simplified grants assessment process should submit the application via ATLASExternal Link , only after ensuring that the following documents are retained on file unless they are requested by VLA for assessment:

  • copies of the charge or charges
  • the lawyer’s assessment of the likely penalty
  • relevant proof of means.
