Guideline 5 – application to revoke a protection order

Victoria Legal Aid (VLA) may provide a grant of legal assistance:

For a parent to initiate or respond to an application to revoke a protection order in the Children's Court (Family Division) where:

  • there is a family reunification order
    and
  • there are reasonable prospects of the child/ren being immediately placed in the care of a parent

For a child to initiate or respond to an application to revoke or vary a protection order in the Children's Court (Family Division) where:

  • there is a family reunification order, care by secretary order or long-term care order
    and
  • there are reasonable prospects of the revocation being made

Simplified grants assessment process

Grants to revoke a protection order are VLA assessed. Lawyers seeking a grant of legal assistance must submit an application via ATLAS, uploading the appropriate documents set out under the relevant guideline in Simplified Grants Process: Notes on the Guidelines and retaining on file the remaining documents set out in the notes.

Lawyers are also encouraged to complete a Children's Court (Family Division) worksheet for their file.
